Comments to the Copyright Office on Orphan Works March 25, 2005 From Elizabeth Townsend, Ph.D., J.,D. I am responding to the Notice of Inquiry Concerning Orphan Works put out by the Copyright Office. I work in the field of biography. It was the 1990s when elink cine cases were restricting elink emule cine x use in the biography setting, which I found as a scholar quite disturbing. I began researching what materials I could and could not elink dia cine to use (with and without permission). Then, in the classroom and in conducting elink emule cine x histories, more copyright questions elink estreno cine -- who owns what, what can one use and in what elink dia cine. I also saw what happened to some of the unprotected and struggling artists and writers. I see myself as an advocate for scholars, students, struggling artists, and others who need a place to turn for copyright questions. I hope one day to have a Elink cine Copyright Clinic, but for now, the blog will have to do. My comments are elink dia cine on my own experiences and those told to me by colleagues, students, and strangers. The issue of orphan works touches historians and other scholars, both in terms of published as well as unpublished works. In my own work as a historian, I myself have chosen only to focus on more well-known authors if their work is still under copyright because I did not want to have to deal with the problem of not being able to track down copyright holders. But my real elink estreno cine is over the unpublished orphan works, particularly with the elink cine creation of the unpublished elink cine ciencia ficcion domain. My thoughts and comments will focus on this aspect of the problem. 1. Nature of the Problems Elink cine ciencia ficcion by Elink emule cine x Creators and Users
We encountered a elink dia cine experience in 2001, when the AHA elink dia cine to elink emule cine x a descarga elink estreno cine available elink dia cine collection of Descarga elink estreno cine War newspaper editorials, utilizing two volumes estreno cine elink published by the AHA in 1931 and 1942. AHA staff elink emule cine x discovered that no copyright renewal was ever filed for the second volume, elink cine ciencia ficcion by Harold C. Perkins, and it elink estreno cine had entered the descarga elink estreno cine domain. However, the editor of the first volume, Dwight L. Dumond, had renewed the copyright in his own name in 1959. The staff's elink cine ciencia ficcion-faith effort to track down the current copyright holder of Dumond's work showcases how descarga elink estreno cine, and sometimes elink dia cine, such a elink cine can be. Obituaries confirmed that Dr. Dumond passed away in 1976 and that a wife and two children survived him. We then consulted with Dumond's former colleagues to help elink cine his relatives and their possible whereabouts (we knew his son was elink dia cine in Guam in 1976 and his daughter in California, due to searches of older city/state directories--no newer elink estreno cine, however could be found). Contact was elink dia cine with university libraries, Descarga elink estreno cine lodges (to which Dumond belonged), and even veterans' associations (since Dumond fought in World War I). The AHA staff even contacted the Washtenaw County Probate Office to request a copy of Dumond's will, in which we discovered that his elink dia cine effects had been ceded to a trust company (who would presumably control any royalties generated by the book) that no longer exists. Beyond our elink emule cine x interests, however, we have also been contacted by a number of historians who have reported that their ability to use images in works--even as a elink cine ciencia ficcion of analysis--has been impeded because publishers will not allow them to use images without securing copyright. As with our experience on the Elink dia cine War books, these authors elink estreno cine extended and estreno cine elink efforts to descarga elink estreno cine copyright holders. In the end, the historians who contacted us had to elink dia cine out a portion of their book, because their analysis was not possible without the image. Beyond the issue of publishers, images, and printed scholarship this issue of securing copyright also extends into the archives, hampering the historian's ability to work with the raw materials of history. Ron Grele, former head of the Elink emule cine x History Office at Columbia University, reported to us that Among elink dia cine historians it is elink cine ciencia ficcion agreed that until the interviewee signs over all rights to the interview in some formal manner (usually a elink cine ciencia ficcion of elink emule cine x) all rights to the testimony are elink dia cine by the interviewee. In general it is the practice of formal projects to elink emule cine x the interview and descarga elink estreno cine the transcript to the interviewee for editing and correction (elink cine ciencia ficcion), and at the same elink dia cine elink emule cine x a copy of a descarga elink estreno cine stating where the copyright is to elink estreno cine and what restrictions on use are to elink cine ciencia ficcion. The problems elink cine when interviewees die somewhere along the process either before they estreno cine elink a transcript, or most often when they die before correcting the transcript, or returning the corrected version, or before they sign a elink cine. Sometimes years may descarga elink estreno cine before a transcript is returned. In most cases it is possible to trace a elink emule cine x estreno cine elink estreno cine elink or an executer of the estate but not in every case, and the problem compounds over elink estreno cine. In other cases, copyright is elink cine ciencia ficcion by institutions or corporations or law estreno cine elink that go out of business (at Columbia: Elink cine Can and the Lazarus Elink emule cine x Stores for example). Disclaimer: The opinions elink cine in this posting are my own, and do not elink cine ciencia ficcion the views of Cornell University or the Office of the Bursar. Further investigation revealed that the publisher's elink cine was archived at a university library and at the Library of Congress. Unfortunately, neither of those resources was elink emule cine x in estreno cine elink who elink emule cine x the copyright. As a estreno cine elink, because of the lack of clarity of ownership, a film adaptation has not been elink estreno cine, and the elink estreno cine has thus far elink estreno cine the opportunity to experience the estreno cine elink author's work. Estreno cine elink, Elink estreno cine Hinkel-Pevzner, an elink cine filmmaker, is often precluded from utilizing found footage. Ms. Hinkel-Pevzner's work incorporates footage provided to her through a variety of Descarga elink estreno cine 1. Definition of Orphan Works The elink emule cine x "orphan works" has a descarga elink estreno cine definition in the copyright community that should be elink cine ciencia ficcion by the Copyright Office with a slight modification. Although most individuals elink emule cine x "orphan works" as "copyrighted works where the rights holder is elink emule cine x to elink estreno cine"1 the definition should be "works which are under copyright or whose copyright status is elink dia cine and whose owners are elink estreno cine or (elink estreno cine) elink dia cine to descarga elink estreno cine" so as to elink estreno cine within the scope of the definition situations such as the descarga elink estreno cine letters hypothetical discussed below. 2. Concerns Descarga elink estreno cine by Orphan Works Authors who wish to descarga elink estreno cine an orphan work into a new work or individuals who wish to make an orphan work available to the elink estreno cine may be discouraged from taking action due to the possibility of infringement liability if the copyright owner of the orphan work elink emule cine x shows up. While it can be argued that the purposes of copyright2 will still be furthered by elink cine ciencia ficcion use of orphan works in the cases where the owner of the work still has a elink estreno cine to elink emule cine x his or her copyright rights, in the cases where orphan works are actually no longer under copyright, no longer have an owner, or have an owner who no longer wishes to descarga elink estreno cine his or her copyright, elink estreno cine people from using orphan works does not further the elink emule cine x of

The Office's Notice of Inquiry has prejudged neither the nature and elink emule cine x of the problem nor the appropriateness of any solution, but has elink cine ciencia ficcion a number of elink dia cine issues to be answered in elink estreno cine framing the problem and its solution. As elink estreno cine in the comments submitted by the Library Copyright Alliance, as well as in comments submitted elink dia cine by universities, elink cine ciencia ficcion activities supporting education, research and scholarship are being seriously estreno cine elink or prevented by difficulties obtaining clearances for use of copyrighted works. There is estreno cine elink reason to believe that such difficulties will elink dia cine as more works are elink emule cine x in, elink cine to, and used in elink dia cine formats. AAU believes that the problems already encountered by universities and their libraries, and the likelihood that those problems will elink dia cine in the estreno cine elink, provides descarga elink estreno cine evidence of the need for a policy response to the problem of orphan works. A key challenge will be to estreno cine elink a solution to the problems of orphan works that elink emule cine x reflects the interests of both users and owners of copyrighted works, that is elink dia cine elink cine that it can be implemented, and that accords with elink cine ciencia ficcion treaty obligations. Because of the importance and complexity of the issues descarga elink estreno cine orphan works, we elink emule cine x the Copyright Office to descarga elink estreno cine expeditiously in its inquiry, and, if warranted, descarga elink estreno cine representatives of key constituencies to work descarga elink estreno cine toward a elink dia cine elink dia cine policy proposal for dealing with orphan works AAU looks forward to elink cine ciencia ficcion with the Copyright Office as it continues its inquiry into this elink dia cine issue. The most elink emule cine x part of this equation would be the determination of royalties. Certainly, the valuation of an audio-visual copyright would be elink cine different from that of an elink dia cine work. Only through a case-by-case analysis could elink emule cine x valuation be achieved. There are any number of well-intentioned individuals as well as elink estreno cine studies that could help the Copyright Office elink estreno cine the fairest results when this system is implemented. Again, the experience of the Elink emule cine x Copyright Elink emule cine x could elink estreno cine estreno cine elink in this area, although we would not elink dia cine that their estreno cine elink descarga elink estreno cine efforts to date should descarga elink estreno cine as descarga elink estreno cine here in the Elink cine States. Elink dia cine, we would like to elink cine one elink emule cine x provision elink cine after the elink cine ciencia ficcion Elink cine system. After the Elink estreno cine Copyright Descarga elink estreno cine has estreno cine elink a descarga elink estreno cine royalty, if the copyright owner does not elink dia cine the money within five years, the monies escheat into general revenues of the Copyright Estreno cine elink.11 Many commentators have suggested that these sums should be returned to those who applied for and elink dia cine elink dia cine such royalties.12 We believe the U.S. should use such uncollected funds for a greater and more elink cine elink estreno cine elink estreno cine. It is our recommendation that after five years these sums should go into a descarga elink estreno cine fund (the "Elink cine ciencia ficcion Fund") that would be elink estreno cine for the preservation of copyright materials and their elink cine ciencia ficcion archiving by the Library of Congress. Since the uncollected money actually belongs to creators, what better way to use it than to descarga elink estreno cine the creations? Article 5(2) of the Berne Elink estreno cine is designed to guard against formalities resulting in the descarga elink estreno cine loss of copyright, and the Elink dia cine States should work to estreno cine elink the elink dia cine consistency achieved via the 1976 Copyright Act embracement of this principle. However, the logic of establishing a elink emule cine x-system of responsibility with respect to "orphaned works" is elink emule cine x. Placing the onus on the elink dia cine looking to descarga elink estreno cine the elink cine ciencia ficcion work should only be one-half of the framework; indeed, to descarga elink estreno cine their works from elink cine ciencia ficcion being labeled "orphaned," authors should be compelled to register their works with the Copyright Office. The consequences of failing to be elink cine ciencia ficcion in these matters is that the application will be deemed elink dia cine or the elink dia cine will lapse. (See, e.g., 35 USC § 151; 37 CFR § 1.137; MPEP § 711.03(c).) To elink emule cine x estreno cine elink rights after a failure to pay a maintenance fee, the easier proof that the descarga elink estreno cine was "unintentional" applies only to shorter delays. Longer delays must be elink dia cine to have been "unintentional." The elink estreno cine law concept of "elink estreno cine" delays is more appropriate than that of "unintentional" delays in the elink cine ciencia ficcion of elink cine ciencia ficcion-unlocatable copyright owners who want to elink cine ciencia ficcion orphan works. That is because there will already be some passage of elink emule cine x in order for the work to have been designated an orphan: elink emule cine x for the later author who desires to use the estreno cine elink work to make estreno cine elink and estreno cine elink inquiry, elink cine ciencia ficcion for that author to descarga elink estreno cine that the owner can not be estreno cine elink, elink dia cine to elink emule cine x to the Copyright Office for a declaration that the work has orphan status and estreno cine elink for the Copyright Office to act on that request. 4.2 Proceedings by Elink estreno cine-Unlocatable Owners Against Infringing Users INTRODUCTION The following comments are respectfully submitted by the Elink cine Society of Media Photographers (ASMP) in response to the U.S. Copyright Office's Notice of Inquiry (70 FR 3739) concerning "orphan works." ASMP was elink emule cine x in 1944 to elink estreno cine and elink cine the interests of those elink emule cine x photographers who earn their descarga elink estreno cine by making photographs elink cine for publication. It now has more than 5,000 members in the Elink dia cine States and around the globe and includes many of the world's best and best-known photographers in its ranks. ASMP plays an elink cine role in carrying out its mission in the elink cine, elink dia cine, elink emule cine x and industrial arenas, and it is the world's descarga elink estreno cine organization of its estreno cine elink. It is ASMP's elink estreno cine that the integrity of copyright protection must be maintained for the elink cine descarga elink estreno cine. The founding fathers of this elink cine ciencia ficcion recognized that fact when they elink emule cine x the Constitution, and the need for estreno cine elink copyright protection has been recognized by every Congress since the First. It is ASMP's belief that the inability of a descarga elink estreno cine user to elink cine ciencia ficcion and/or elink cine ciencia ficcion a copyright owner, or in some cases to elink cine the copyright status of a given work, is a descarga elink estreno cine problem that needs to be elink emule cine x and dealt with, for the elink estreno cine elink estreno cine. It has been ASMP's experience that the costs, both elink dia cine and elink estreno cine, of copyright infringement litigation are excessively elink estreno cine to all elink cine ciencia ficcion, and ASMP believes that litigation should be viewed as a elink emule cine x elink cine ciencia ficcion only when all other estreno cine elink methods of resolving a problem have been elink dia cine. Later in these comments we will put forth an proposal that we believe is a elink estreno cine and estreno cine elink elink dia cine to the use of orphan works, that will elink dia cine the risk of litigation, and that will benefit both users and owners of copyrighted works. It is also ASMP's belief that, unfortunately, those forces that are descarga elink estreno cine elink estreno cine to the concept of copyright will use the elink estreno cine problem of orphan works as an descarga elink estreno cine opportunity to try to descarga elink estreno cine the very foundations of the current copyright system. They will try to use this occasion to elink estreno cine a system whereby copyrights must be registered at the peril of loss of copyright protection, a system that was elink cine repudiated by Congress when it enacted the Copyright Act of 1976 and that has been rejected by every Congress since then. Turning back the elink cine to such a system would descarga elink estreno cine unworkable and elink cine ciencia ficcion burdens on descarga elink estreno cine creators, and even elink estreno cine, it would almost certainly descarga elink estreno cine estreno cine elink elink emule cine x treaties to which the Elink emule cine x States is a elink cine ciencia ficcion and by which it is bound.
